Recorder Information
Business and Professions Code 6125 prohibits the Recorder Department from giving any legal advice. The Recorder Office cannot assist anyone in the preparation of documents, because such assistance constitutes legal advice and state law prohibits the office from offering legal advice.
County recorders are not responsible for verifying the validity, authenticity, or legitimacy of the documents that are recorded. In other words, the recorder is not responsible for detecting a fraudulent document, and the recorder does not look beyond the document itself. If the document meets the essential recording requirements, and the proper fees are submitted, the county recorder is obligated to and will record the document.

AB 1466 PLAN
Summary
Pursuant to the 2021 legislation set forth in Assembly Bill (AB) 1466 and California Government Code Sections 12956.1, 12956.2, 12956.3, 27282, 27388.1, and 27388.2 requires that all Recorders of California Counties (beginning July 1, 2022) shall establish a restrictive covenant plan to assist in the redaction of unlawfully restrictive covenants.

If a member of the public (As presented in AB 1466, Chapter 359) presents our office with a document they identify as having restrictive language, the following process will take place:
- The Recorders office will present the document to County Counsel for review and direction.
- County Counsel will review the document and provide the Recorder’s office direction on redaction for Restrictive Covenant Modification or identify whether the document is denied and not to be redacted under Restrictive Covenant Modification.
- County Counsel has ninety (90) days to review and return the document to the Recorder’s office with a decision.
